1. Purpose and scope

These terms and conditions of sale (the "Terms") govern all sales concluded on the Lumiria online shop, available at https://lumiria.app (the "Site"), between the company MENDING and any consumer customer (the "Customer"). Placing an order on the Site implies unreserved acceptance of these Terms.

3. Products

The product sold is a portable projector: a unit with Android, wifi, an HDMI input and a USB port, supplied with a swivel base. The essential characteristics are set out on the product page. The photographs illustrate the product as faithfully as possible; minor variations in colour may occur depending on the screen.

This product is not a toy. It is an electrical device intended for domestic indoor use: it must be kept out of the reach of young children and the lens must not be looked into directly.

4. Prices

Prices are shown in euros, all taxes included, with French VAT at the applicable rate. They do not include any delivery charges, which are shown before the order is finally confirmed. MENDING reserves the right to change its prices at any time; products are invoiced on the basis of the prices in force when the order is confirmed. An invoice is issued for every order.

5. Orders

Orders are placed on the Site: products are added to the basket, the summary is checked, delivery details are entered, then payment is made. The sale is deemed concluded once payment is confirmed. MENDING confirms the order by email. MENDING reserves the right to refuse any abnormal order or any order placed in bad faith.

6. Payment

Payment is made online, in full, by the means offered at checkout (payment is handled by the secure provider of the Shopify platform). The order is dispatched only once payment has actually been collected.

7. Delivery

Products are delivered to the address given by the Customer when ordering. The indicative delivery time is three (3) to five (5) days. Products are dispatched from a warehouse located in the European Union. In accordance with article L.216-1 of the French Consumer Code, delivery takes place no later than thirty (30) days after the contract is concluded, unless otherwise agreed. Failing that, the Customer may terminate the contract after having unsuccessfully instructed MENDING to deliver within a reasonable additional period.

Delivery is free, with no minimum order.

It is for the Customer to check the condition of the parcel on receipt and to report any damage or missing item as soon as possible.

8. Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the product to exercise the right of withdrawal, without having to give any reason. The Customer notifies the decision to MENDING by any means expressing the wish to withdraw: using the online withdrawal form, or by email to the address given in article 2.

The Customer returns the complete product, in its original packaging, no later than fourteen (14) days after notifying the withdrawal. Return costs are borne by the Customer. MENDING refunds all sums paid, including the initial delivery costs (at the standard rate), no later than fourteen (14) days from recovery of the product or from proof of its dispatch.

A product that arrives broken or faulty is not a matter of withdrawal but of the legal guarantee of conformity (article 9): in that case no return is requested and the costs are borne by MENDING. See report a broken or faulty product.

The Customer may be held liable for any depreciation of the product resulting from handling other than what is necessary to establish its nature and characteristics.

9. Legal guarantees

Independently of any commercial warranty, the Customer benefits from:

the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code): for two (2) years from delivery, the Customer may obtain the repair or replacement of a non-conforming product, or failing that a price reduction or termination of the sale;

the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code): the Customer may choose between termination of the sale and a price reduction.

To invoke either of them, contact MENDING using the details in article 2.

9 bis. Take-back of used electrical equipment (WEEE)

The projector sold on the Site is electrical and electronic equipment. In accordance with articles L.541-10-8 and R.543-180 of the French Environment Code, MENDING takes back used equipment of the same type as the one sold free of charge, on a one-for-one basis. For distance selling, this take-back takes place at the place of delivery.

To benefit from it, the Customer makes the request before or at the time of the order, stating the device to be taken back. The Customer may also drop used equipment off free of charge at a recycling centre or at the collection points provided for that purpose. Electrical equipment must not be thrown away with household waste.

See take-back of your old device.

10. Liability

MENDING cannot be held liable for damage resulting from abnormal use of the product or from failure to observe the usage precautions (electrical device, light source not to be looked at directly, indoor use). MENDING cannot be held liable for non-performance due to an event of force majeure.

11. Personal data

The data collected when ordering is necessary to process the order (order handling, delivery, invoicing). It is processed in accordance with the GDPR and the French Data Protection Act. The Customer has a right of access, rectification, erasure and objection, which may be exercised using the details in article 2. See also the legal notice.

12. Consumer mediation

In accordance with article L.612-1 of the French Consumer Code, the Customer may use a consumer mediator free of charge with a view to the amicable resolution of any dispute. Appointed mediator: CM2C, 49 rue de Ponthieu, 75008 Paris, www.cm2c.net. The Customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

13. Governing law

These Terms are governed by French law, without the consumer Customer being deprived of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute and failing an amicable settlement, the competent courts are designated according to the ordinary rules of law.
